Nongsim lost Jeju Samdasoo Trademark dispute

Jeju special self-gorvering province development Corporation (JPDC) won to take back ‘Jeju Samdasoo’ trademark. Samdasoo is a brand of drinking water in Korea and it's the 1^st in drinking water category since it has launched.

Nongsim had a contract with JPDC as a selling agent. The 2 companies had the first contract with a condition that Nongsim's trademark right for 5 years after the contract would canceled. When they renewed the contract in 2002, the 5 year trademark right condition was removed but Nongsim applied trademark ‘Nongsim Samda’, ‘Nongsim Samdasoo’ and ‘Nongsimg Samdado’.

After the contract was expired in December, 2012, JPDC asked to transfer or cancel the trademark right, but Nongsim refused. JPDC requested for arbitration to Korean Commercial Arbitration Board and it pulled for JPDC.
