Google bought Hon Hai's wearable device patent

According to Bloomberg on August 23rd, Taiwan Hon Hai Precision Industry, a primary assembler for Apple sold Google part of a patent portfolio for wearable technology used in gaming and training simulations.

The technology sold to Google is the head-mounted display technology consists of a computer-generated image that is superimposed on a real-world view.

The transaction between Hon Hai and Google may allow Google to leverage its content strength and seek manufacturing contract from the US firm on wearable-computer devices according to Edward Chen, a research analyst at Taipei-based First Capital Management INC.

It will be blocked the act of ‘Trademark Broker’ which applies the trademark imitated foreign trademarks and famous celebrities and so on. 

According to KIPO, the number of imitated trademark application in 2012 (912 cases) has been increased 10 times more than in 2008 (90 cases).  Recently, a person applied 730 cases of imitated trademarks including foreign famous trademark imitations in a month.   

In addition, the disinterested party applied Korean famous broadcast program title as trademarks such as ‘The Rules of Jungle,’ ‘Infinite Challenge,’ and ‘The Moon incubating Sun.’

KIPO decided reinforce the examination process to prevent this kind of phenomena by blocking entities which had trade connection with foreign companies apply foreign companies’ trademark registration.   

For this reason, domestic trademark registration without foreign trademark right holder’s approval to preoccupy the foreign trademark will be blocked as the trade connection between applicant and right holder proved.

H&M copyright lawsuit over LA fingers image by Estevan Oriol

Estevan Oriol, a Mexican American photographer and director, has filed a copyright lawsuit against H&M, a famous fashion retailer. H&M has sued for using ‘LA Hands’ image which was taken by Estevan Oriol.

According to Business Times, The photo of a female model’s fingers forming the letters ‘LA’ for Los Angeles became iconic symbol of LA and Estevan Oriol produced t-shirts with the photo in 2006. 
"If you put my photograph side-by-side with their re-creation of my image, anyone would tell you they are one in the same…they clearly copied my image," Oriol said in the file.

'Bad Apples Can Be Good Fruit' vs. 'Good Deeds', Hollywood did not infringe.

Terri V Donald lost her copyright infringement case. He claimed that Hollywood producer Tyler Perry and film studio, Lions Gate Entertainment Corp, used his story and characters from her novel ‘Bad Apples Can Be Good Fruit’ which was published in 2007, law360 updated.

According to the file, she said that she had sent her book to the Tyler Perry Co., hoping the company would buy her story, but Perry and Lions Gate made their own film with her story. 

Given that the book and film concern dissimilar characters in different settings, it comes as no surprise that the plots, sequence, pace and total concept of the two works are completely different,” the court rued, law360 added.

Chipotle Mexican Grill Inc. and Jack in the Box Inc. has settled a trademark dispute over the term “chipotle”.

According to Bloomberg Business Week, Chipotle sued the burger chain Jack in the Box for using the work ‘chipotle’ for their new burger’s name. Chipotle claimed that the company used the term which was already known as its Mexican food brand. Moreover, customers’ would assume that the two companies had partnership with each other.

Chipotle Inc. started its business in 1993 and registered the term as trademark in 1998. The word ‘chipotle’ is originally and commonly used for smoked dried jalapeno.

US 3D Systems’ “laser sintering” (SLS Type: Selective Laser Sintering) 3D technology related patents will expire in February 2014. The Selective laser sintering print chemically pure, fully dense metal and ceramic parts from very fine powers with a particle size ranging from 6-9 microns.

Telsta facing Patent Infringement lawsuit by Upaid

Telsta, an Australian telecommunications and media company, has been sued for infringement of two technology patents, Financial Review reported.


Upaid Systems has sued several telecommunications companies in recent years and it filed documents against Telstra this in August, 2013. It claimed that the company infringed patents so their customers can purchase on BigPond.com portal site or Telstra mobile while roaming overseas.

Upaid is seeking a permanent injunction on Telstra’s use of the technologies without a licence, article added.

Robin Thicke 'Blurred Lines' Copyright Infringement dispute

 Robin Thicke’s song ‘Blurred Lines’ which is the song of this summer and No.1 hit on Billboard chart for 10 weeks, has been accused for copyright infringement. Robin Thicke, Pharrell Williams, and T.I. filed a lawsuit to claim that the song does not infringe Marvin Gaye’s ‘Got to give it up’ and George Clinton’s ‘Sexy ways’.  


The lawsuit, owners of Gaye's "Got to Give It Up" and Funkadelic's "Sexy Ways" have threatened legal action over copyright infringement if the composers of "Blurred Lines" do not pay a monetary settlement, Reuter reported.

Oracle vs. Uracle, It's not a trademark infringement.

Uracle, a Korean mobile solution company, has won a trademark suit against US company Oracle, Yonhap News reported.   

Oracle lost the first trial. Court dismissed the appeal and recently the judge ruled against Oracle. The judge ruled that Uracle is one of leading companies in Korea with lots of award winnings and it has been recognized for its technology and service to Korean customers.

 Korean couple matching TV show, ‘Jjak’ (meaning ‘a pair’) lost the copyright lawsuit against SNL Korea and the director said that he’ll appeal against SNL Korea.

SNL Korea had some sketch comedies in their show with the concept of ‘Jjak’. Jjak sued SNL Korea for copyright infringement and claimed that it violated the value of the show. Court said the show was not infringed because of the show’s common theme and form.

After the ruling, the director ‘Nam Kyu-hong’ said that the program should be respected as original work and they did not refer any other TV programs. They decided to appeal because the creativity of their show was not recognized, he added.

Prediction of Samsung's Upcoming Technologies and Services

Samsung Electronics filed several new brands’ trademarks which show the direction of its next-generation products and services.



According to the USPTO, Samsung Electronics filed 7 new trademarks in June.  Its submitted trademarks are “Samsung Micro, Mobile Samsung 5G, Samsung Fit, Samsung Expo, Samsung Go, Samsung Pro, and Samsung Musician.”

These trademarks possibly are applied to Samsung’s brand new mobile equipment, accessories, or services. Some of these trademarks give some hints that there will be music or health specialized services will be provided by Samsung.
