Korea Intellectual Property Office starts to help 'Creative Economy Town'

Korea Intellectual Property Office (KIPO) announced that it will help to develop ‘Creative Economy Town’ with Ministry of Science, ICT and Future Planning (MSIP) on its web site.

Creative Economy Town is a web site that people can participate in proposing, developing and commercializing ideas. According to the article, they have received over 1,200 proposals for ideas in 2 weeks.

KIOP will look into the ideas from the members and select best/proper idea with technological innovations and potential competitive in current markets.

Creative Economy Town is a detailed platform to create markets and jobs by making use of people’s creativity as a resource. It was established so that anyone with a creative imagination can play a leading role in the creative economy,” KIPO’s Director, Yong-seon Kim said.

Korea Copyright Commission (KCC) Signs MOU with Baidu



Korea Copyright Commission (KCC) and China's largest search engine site Baidu signed the MOU in 28 October, KCC announced on its website.

With this agreement between two organizations, they will cooperate to
- protect copyright and fair use
- delete illegal works in China
- share information of fair use and lawful distribution
- build proper foundation for right relationship

The chief commissioner Yoo said that this agreement with Baidu will be the first step for copyright protection and lawful distribution and they are planning for extension of cooperation with other web portal sites in China in the future.

Jack Daniel's sues Popcorn Sutton to protect its trademark

Jack Daniel sued Popcorn Sutton claiming that its square bottle and the black-and-white label, The Inquisitr updated.

The lawsuit claimed the bottling and labeling of Popcorn Sutton is “confusingly similar” to its products. The suit added that “Tennessee whiskey is one of the oldest, longest-selling, and most iconic consumer products in the history of the United States” Jack Daniel is seeking for an injunction to stop Popcorn Sutton from using their bottle and labels and also damages.

Samsung's Smart Glasses

It seems to Samsung is looking to build its own smart glasses. According registered design in South Korea, Samsung named the device as “sports glasses,” with integrated headphones that would allow users to take phone calls and listen to music. 



The filing includes several drawings of the devices.  Based on the drawings, there seem no big differences between Samsung smart glasses and Google Glass.  The only difference between them would be Samsung’s emphasis on the device being used for sports and exercise.

LG is the largest LTE-A related patents holder in Korea.

According to Business Korea, LG electronics holds most LTE-A patents in Korea.  KIPO reported that the applications for LTE-A related patents began in late 2008 and it drastically increased from 2010.

LG is holding the largest number of LTE-A related patents; 426 patents, 24% of the total number of LTE-A related patents in Korea. Pantech is the next-largest patent holder with 141 patents (18%), and the next follower is Samsung with 295 patents (16%).

Foreign firms are also major LTE-A patents holder in Korea.  Qualcomm, Ericsson, ZTE, and Nokia have 282 patents, 43 patents, 43 patents, 31 patents, and 20 patents.

Darrelle Revise owns 'Revis Island'' trademark


The football team Tampa Bay Buccaneers’ cornerback Darrelle Revis has been awarded ‘Revis Island’ trademark, NFL reported. He filed this trademark registration 3 years ago which was earned as his nickname during his time in New York. 

Now his trademark has registered, Revis can expand his business with this name but it is not clear what Revis plans to do with ‘Revis Island’ term yet. NFL added that he might consider trademarking for ‘Revis Zone’.

Women Bags brand 'MCM' wins a case against fake bag maker

Women bags brand MCM’s trademark holder SungJoo DND announced that they won a claim for damages from trademark infringement.

The company sued the fake bag seller for infringement their trademark and he was sentenced to 10 months imprisonment. He manufactured fake bags and wallets in large quantity and distributed them in 2011.

The accused appealed again but the court dismissed his appeal and made final decision of 10 months imprisonments.

Korean Drama 'Ya-Wang' copyright infringement dispute


Korea drama ‘Ya-Wang’ (Queen of Ambition), which was ended April 2013, is facing a copyright dispute.

Korean TV & Radio Writers Association announced that they expelled the writer for copyright infringement and the drama production company and the writer opposed strongly.

The company argued that the story was based on original cartoon named ‘Dae-Mul’ which was published 7 years ago and it was pretty popular. It also added that this copyright dispute and expulsion was unreasonable.
The writer who was expelled is preparing for a lawsuit to stand against the Association.

Ya-Wang’s writer was changed before it was produced because of writer’s story and schedule. Company claimed that the former writer and Association took this issue for unfair reasons.

The band name 'The Slants' is disparaging term for Asian, PTO says.

The Slants, Asian American dance rock band from Portland, Oregon, tried to have their name ‘The Slants’ as trademark. But Patent and Trademark Office (PTO) refused their request saying that ‘slants’ is a 'disparaging term for Asian descent', NPR reported.

NPR added Simon Tam’s comment: “"They said because of our ethnicity, people automatically think of the racial slur as opposed to any other definition of the term,"

Now the band is planning to take their case to a federal circuit court with a different strategy that denying them the copyright violates their First Amendment rights.

Korean Patent-Net arrives in Africa

The KIPO net system is going into the African continent.

KIPO and KOICA (korea International Cooperation Agency) hosted launching session in Harare, Zimbabwe on 7th, for modernization of the African regional intellectual property offices’ (ARIPO) patent information system.

ARIPO is the patent organization for English speaking African 54-nation members including Zimbabwe, Kenya, and Mozambique and so on.

Femando dos Santos, the secretary general of ARIPO,  the minister of Zimbabwean Ministry of Commerce, and the minister of Zimbabwean Patent Office attended at this session and reflected African interest and expectation for Patent-Net service platform for English speaking countries.  The deputy head of department of KIPO, Ambassador of Republic of Korea to Zimbabwe, and the team leader of WIPO attended the session from Korean side. .   

KIPO has been promoted international cooperation projects for developing countries’ modernization of administration process by using KOICA’s GRA projects.  ARIPO patent-net building project will be funded 580 million dollars in two years.

Starbucks files their new word 'Fizzio' trademark

Starbucks filed a trademark application for the name "Starbucks Fizzio" which is created for their new line of soft drink machines, The Atlantic Wire reported. It says that the name is for beverage making machines, as well as a variety of drinks, including soft drinks.
 
Zack Huston,Starbucks' spokesman, said to NBC news that it’s related to the company’s test of sodas in Atlanta and Austin. Starbucks has been testing 3 flavors - Lemon Ale, Original Ginger Ale and Spiced Root Beer- he added.

This trademark filing may be the first step for Starbucks’ new business expanding of carbonated drinks.

Kakao Talk's Patent dispute settled

Patent dispute surrounding Kakao Talk have been settled.

Kakao have Kakao announced on 9th, that they have received Supreme Court’s final judgment.

Korean Supreme Court judged regarding Miu Technology’s patent; ‘Data transmitting/ Receiving system having a movable datat repeater (10-0735620)’ is invalid because there is prior-art exist in the US and Korea, and Miu’s patent is not different from existing patents in terms of its purpose, structure and effect. 

Miu Technology brought criminal charges against the CEO of the Kakao Talk in March 2012, alleging that Kakao infringed upon its patents.

IP5 offices agree on joint PPH pilot programme

Korea Intellectual Property Office, KIPO updated ‘IP5 offices agree on joint PPH pilot programme’.
According to the article, world's five largest Intellectual Property Offices (IP5) agreed to launch a comprehensive IP5 Patent Prosecution Highway (PPH) pilot programme as of January 2014.

"I am pleased that the first ever all-inclusive PPH pilot programme is launched under the PCT framework. It is a very promising step on the way of facilitating the life of users in five big economic regions which represent 85% of the patents granted in the world" noted EPO President Battistelli on EPO.

Also JPO Commissioner Hideo Hato said on JPO “It is gratifying that the start of the new IP5 initiative enabled us to present a strategic tool to the users in a simple manner. We should not be satisfied with this achievement. We will further discuss how to improve quality and management systems through the PPH arrangements among the IP5 Offices and make efforts to further strongly support the global activities of the industry.”

'GagaJeans' maker decides to change its name to 'Pheiress'

A blue jean manufacturer announced that their product’s name has been changed because of Lady Gaga claimed trademark infringement, Bloomberg updated.

The ‘GagaJeans’ which has zippers each bottom side and inner side of crotch, was registered a design patent on April 23. According to the maker, he received lots of negative comments about the name ‘GagaJeans’ and the famous musician Lady Gaga accused them of trademark infringement.

Now the products name has been changed to ‘Pheiress’. He said he decided to produce first 250 products with the new name. He will take into consideration all names that people have submitted for the actual brand name, he added.
