Weekly Korean IP Headlines 02.28. 2013

Asia Economy reported on 21st, KIPO’s patent information search and electronic filing education project though visitation is popular. The project is popular because professional instructors from Korea Institute of Patent Information to the remote area and the fee are free.  According to KIPO, the education project started from 2007, made 750 times of education for small and medium companies, universities, local IP center, and business incubators. 

Basic course curriculums are ▲patent and utility model search, ▲ trademark & design search, ▲electric filing of patent and utility model, ▲ electric filing of trademark & design.  There are also advanced course curriculums such as ▲ patent search (international patent), ▲ electric filing (PCT), ▲ electric filing (Madrid), etc.

AVING Global Netwrok reported on 22nd, Korean Invention Promotion Association announced that they will host ‘2013 Invention Education Conference’ from February 27th to 28th at Seoul Educational Cultural Center for teaching staffs.  At this event, the case of US and Japan will be presented with simultaneous interpretation.  The conference will provide creative invention education teaching skills and good education operation model for invention education teaching staffs.  The participation fee is free.  Download format and apply through the website of the Korean Invention Promotion Association (KIPA: www.kipa.org) for the registration. A musician spends $30,000 to cancel 'power hour' trademark

An independent musician from Pittsburgh, Ali Spagnola, has won the cancellation of the ‘Power Hour' drinking game trademark. She spent $30,000 of her own money on the case for 3 years, Forbes reported.

An independent musician Ali Spagnola wrote many drinking songs and played them at her “Power Hour” concerts. She sold some products and CDs as well. Then Spagnola faced a legal problem with the term of ‘power hour’ which already had trademarked by a company. She took this issue to the courts claiming that ‘power hour’ was a general term and had wide use.

Essentially, my argument was that ‘Power Hour’ is not entitled to trademark protection because it is the commonly known name for a drinking game in which one shot of beer is consumed for one minute for a period of one hour,” Spagnola’s attorney, William Lang IV, told Alex Knapp of Forbes.

Finally U.S Patent and Trademark Office agreed that ‘power hour’ was not a legitimate trademark.

Zynga Sues game company Imagenesis for use of ‘ville’

Zynga which owns famous social media games ‘CityVille’, ‘PetVille’ nad ‘FarmVille’ filed the lawsuit against Imagenesis Corp. for using its ‘ville’ trademarks. Imagenesis Corp. is going to launch a new game named ‘MafiaVille’, Intellectualpropertynews.com reported.

Zynga claimed that over 65 million people already played its "Ville" games on Facebook and mobile phone apps before Imagenesis named their game as ‘MafiaVille’. 

Imagenesis decided to use the name ‘Mafiaville’ and filed a trademark application with the U.S. Patent and Trademark Office. Imagenesis also filed for a declaratory judgment that ‘MafiaVille’ does not infringe Zynga's trademarks. However, Imagenesis failed to have counsel appear on its behalf and the action was dismissed, Intellectualpropertynews added.

‘Batsman’ can be used for cricket goods because of ‘Batman’

The UK Intellectual Property Office (UKIPO) has rejected the trademark ‘Batsman' because the mark is similar to DC Comics' ‘Batman' and it would cause consumer confusion, dailymail.com reported.

Adelphoi Ltd, a London based sound and design company, wanted to use the name Batsman for their cricket goods but judge said that the two terms 'may easily be mistaken for one another'. Intellectual Property Office adjudicator Oliver Morris added that 'The marks look (and sound) so close that the difference in concept is likely to go unnoticed. If the difference goes unnoticed then the conceptual difference has no material effect. There is a likelihood of confusion.', dailymail wrote.

eBay Sued for allegedly infringing

eBay Inc. was sued for allegedly infringing patents that related to the display of auction information online technology, tamebay.com reported. Patent-holding company Advanced Auctions LLC claimed that eBay used their technology to update bid and pricing information in the last hour of an auction. 

Advanced Auctions LLC explained that “eBay’s webpages present bidders with information regarding the time remaining in the auction and the current bid amount. Before the final hour of the auction, Defendant eBay does not automatically update its webpages with this information. Rather, the bidder must manually refresh their browser to request and obtain current auction information. In the final hour of the auction, this information is automatically updated“, in their complaintTamebay said. Advanced Auctions is seeking for a judgment that eBay’s infringement, damages and injunction preventing.

Ebay had patent infringement issue in July 2010. EBay was sued for $3.8 billion by XPRT Ventures that accused eBay of stealing information shared in confidence by the inventors on XPRT's own patents. Read more about this issue on Reuters.

According to KIPO, Korean singer psy’s management company, YG Entertainment recently applied additional application of ‘Gangnam Style’ trademarks for 20 items.  According to the original article from AsiaEconomy, YG previously applied trademarks for 40 items including fruit juice, beer, and cocktail drink etc.  Currently, there are 16 Gangnam Style trademarks in English and 39 trademarks in Korean. YG is aggressively applying trademark applications because some Korean domestic companies are applying trademark applications without paying loyalties to YG Entertainment. For instance, Korean Crown Bakery already applied ‘Crown Gangnam Style’ trademarks which is a slight modification of ‘Gangnam Style’ for 20 items including pudding, peanut cracker, rice cake, biscuit and etc. Meanwhile, applying ‘Gangnam Style’ trademark itself is deniable due to the word ‘Gangnam’ is the name of special place in Korea. Korean cities Moonkyoung and Youngju are famous for their well-known local products, apples.  Not long ago, there were fight between those two cities because of their promotional words and phrases for apples.  Since 2010, Moonkyoung city used the phrase, ‘The Moonkyoung Apple that Snow White Loved’ to promote their apple.  However, Youngju city also used the phrase ‘The Youngju Apple Smitten by Snow White’ and advertised with this phrase since 2012.  Since both cities used the word ‘Snow White,’ customers got confused by that.  Moonkyoung city remonstrated against Youngju city for using the word, ‘Snow White’ since Moonkyoung city registered the trademark registration first. KIPO also gave an authoritative interpretation for this matter which could be a trademark violation if anyone uses the ‘Snow White’ other than Moonkyoung city.  Eventually, Youngju city gave up using ‘Snow White’ for its promotion and remove all those promotion phrases from their advertisement.  Korean Kyounghyang News reported.  Check out the original Korean article here

Tiffany & Co. Sues Costco for selling fake rings

A luxury American multinational jewelry and silverware corporation Tiffany & Co. has filed a trademark infringement suit against brand-discount retailer Costco Wholesale, Wall Street Journalreported. Tiffany & Co. is seeking millions in damages from Costco for selling counterfeit engagement diamond ring labeled ‘Tiffany Platinum’.  

Tiffany sells its jewelry only at its own retail stores. The fake rings were determined because Tiffany has microscopic laser inscription on its diamonds. The rings from Costco were not engraved with the Tiffany & Co. trademark.

Costco immediately removed all products right after Tiffany & Co. contact last December. But Tiffany said it decided to file suit after because Costco had sold rings for "many years," according to the lawsuit, WSJ added.

Mary Kay and Michael Kors Trademark Fight

Mary Kay and Michael Kors are going to have legal fight over use of initials ‘MK’ for their cosmetic products. Mary Kay sued Michael Kors and claimed injunction and damages for breach of contract, courthousenews.com reported.

The two companies already had legal issues. In 2005, they settled a dispute over Kors’ use of ‘MK’ marks and Kors twice asked in 2011 to register the MK charm logo mark, but Mary Kay refused, according to courthouse.

Mary Kay, Inc. is a privately held company and sells cosmetics products. According to Direct Selling News, Mary Kay was the sixth largest direct selling company in the world in 2011.
Michael Kors had legal issues with TonyDuquette for trademark infringement after Kors allegedly used Duquette’s name and images in his collection in 2009.

Facebook Facing Legal Action Over 'Like' button

Facebook, one of popular social networking sites, is facing legal action over its ‘Like' button. Dutch patent-holding company claims that Facebook uses the button without permission which they already used on Surfbook website, UPI reported.

The widow of a Dutch programmer Joannes Jozef Everardus van Der Meer sues Facebook for using like button and other patented technology that her husband developed. Rembrandt, a patent holding company, said that Van Der Meer granted the patents in 1998 befor Facebook was created and Facebook had no comment about this legal action, UPI wrote.

Surfbook was an early social networking service created by Dutch programmer Joannes Jozef Everardus van der Meer in the years prior to his death in June 2004. Surfbook was based on technologies whose patents were filed by Van der Meer in 1998[2] and granted in 2001 and 2002.[3] It allowed users share their information with selected people and approve posts using a "Like" button, and to link to external information.
