Jusung Engineering defeated Applied Material

Jusung Engineering CO., LTD. (“Jusing”) a semiconductor and display equipment manufacturer of Korea has been sued for plasma-enhanced chemical vapor deposition (PECVD) system, one of major equipment for manufacturing liquid crystal display devices (LCDs) in Taiwan by Applied Material INC. (“AMAT”) of the US.

The patnet infringement between Jusung and AMAT lasted more than nine years.  AMAT requested a provisional injunction to ban on sale and importation of the plasma-enhanced chemical vapor deposition system, claiming that Jusung had infringed AMAT’s patent entitled “Suspension Gas Distribution Manifold of Plasma Chmaber” in June 2004.

It seemed Jusung defeated AMAT in 2011 when the Taiwan Patent Office dismissed the AMAT’s request and rendered a decision favorable to Jusung.  However, AMAT appealed against the court decision.

Recently, Taiwan Patent Court judge ruled against the plaintiff again.  During the court of appeals, the judge decided that Jusung Engineering’s technology is not belongs to the AMAT’s claim of patent infringement.

It seems like Jusung Engineering has achieved its own technologies’ recognition from the court.  The interested person stated that the litigation was about global leading companies dragging down the follow-up companies by over issuing the lawsuits.  Because of this time’s ruling, major companies will not indiscriminatingly claim lawsuits against follow-up companies any more.  

In addition, Jusung Engineering criticized that AMAT is enjoying monopoly in the market by issuing patent litigation which has caused the loss of Jusung Engineering as well as Taiwanese LCG panel manufacturers. 

Applieid Material Korea didn’t get the related content about this litigation yet. 

Even though Jusung Engineering won the first and the second trial, AMAT may appeal again.
It is recommended that restrain indiscriminate patent litigations which may block the new appear of new technology.
