Nestlé won the trademark battle over Kit Kat’s shape against Cadbury, marketingmagazine.co.uk reported. KitKat's shape was already registered in 2006 but Cadbury
applied to invalidate it claiming because the shape could not be trademarked
and it’s also too general to be. But now, the decision has overturned with Nestlé s new appeal.

Nestlé and Cadbury recently had a history of trademark issuesof distinctive purple color for wrapping in last October. The British Intellectual
Property Office (IPO) allowed Cadbury to have the trademark in 2008, but Nestle
objected that it was not unique and should be free for everyone. Judge Birss added that "The evidence clearly supports a
finding that purple is distinctive of Cadbury for milk chocolate." independent.co.uk reported.
