The UK Intellectual Property Office (UKIPO)
has rejected the trademark ‘Batsman' because the mark is similar to DC Comics'
‘Batman' and it would cause consumer confusion, dailymail.com reported.
Adelphoi Ltd, a London based sound and
design company, wanted to use the name Batsman for their cricket goods but judge
said that the two terms 'may easily be mistaken for one another'. Intellectual
Property Office adjudicator Oliver Morris added that 'The marks look (and
sound) so close that the difference in concept is likely to go unnoticed. If
the difference goes unnoticed then the conceptual difference has no material
effect. There is a likelihood of confusion.', dailymail wrote.
