Thomas Pink vs. Victoria's Secret PINK trademark infringement issue


Thomas Pink sued Victoria’s Secret ‘PINK’ brand for using same work ‘pink’ and Victoria requested a declaratory judgment that it does not infringe Thomas Pink’s trademark and they can protect its ‘PINK’ brand name.

According to Law360, Victoria’s Secret had used the name since 2001 and it has more than 1,000 stores. They are well known lingerie brand and “never caused an instance of consumer confusion.” Thomas Pink, U.K clothing brand, started its business in 1980s.
