Tommy Gun Trademark lawsuit, Gun maker vs. Vodka maker

A gun maker company, Saeilo Enterprises sued a liquor maker for using the name ‘Tommy Gun’ which is trademarked. Saeio is the owner of the Tommy Gun trademark since 1920 and it said Alphonse Capone Enterprises Inc. has been trying to tread on that fame by selling a product called Tommy Guns Vodka, Law360 reported.

Saeilo also claims that Alphonse infringes the shape of bottle which shaped like the famous submachine gun. They want a permanent injunction barring Tommy Guns Vodka from store shelves, as well as an award of damages, attorneys' fees and costs, Law360 added.

Saeilo sued Buzz Bee Toys, Inc for selling toy guns and using ‘Tommy’ for name in 2011. The case settled.

Bikinis Sports Bar & Grill trademarks the term ‘breastaurant'

It is getting huge the restaurant industry like Hooters, Twin Peaks and the Tilted Kilt. A Texas restaurant, Bikinis Sports Bar & Grill, has trademarked the term ‘breastaurant' which  has been called as an industry term for restaurants with skimpy dressed waitresses.

According to ABC News, Doug Guller, who owns Bikinis Sports Bar & Grill, announced that he has trademarked "breastaurant" through the United States Patent and Trademark Office.

"Hooters should be very scared," said Drew Neisser of Renegade Marketing Group to ABC News. "The category can only grow so much. Tilted Kilt and the others are stealing Hooters' customers.", ABCNews added.
