BOTULEX applied its trademark in 2005 but the
Trademark Trial and Appeal Board (TTAB) has rejected because buyers might be
confused that the two products are same or related.
According to the article by Mandour & Associates, APC, KRL Group, Inc, the BOTULEX manufacture company,
filed it trademark application in 2005 and they emphasized its strength to
customers as “Injection-free”. The lawyer for BOTULEX said that there are differences
between two products. BOTULEX’s skin care product including creams, toners and
serums don’t require doctor’s prescription.
