Nike vs.Fuel clothing Company Inc, Fuel abandoned 'fuel' trademark

The global sport brand Nike was sued for using trademarked term ‘Fuel’ by Fuel clothing Company Inc. last year, but it abandoned the trademark. Fuel sued Nike in February 2012 when Nike started to sell Nike+FuelBand products with ‘Fuel it up’ and ‘Fuel this’ slogan. Nike countersued in May 2012.

According to law360, South Carolina federal judge that Fuel Clothing Co. Inc. granted naked licenses for its trademark and thereby abandoned it. Nike said that it has no probabilities to make consumers confused even if Fuel clothing Company Inc. didn’t abandon the mark.
