A Swiss multinational nutritional, snacks,
and health-related goods company Nestlé has won a trademark appeal against Mumbai-based
company Swaraj, Business Standard reported.
Nestlé filed a trademark petition for its
trademark term ‘Maggi’ claiming that Swaraj registered same trade for its
products and it would cause confusion and deception. Swaraj said they had been
using ‘Maggo’ trademark since 1984. Nestle argued that ‘Maggi’ was from the
name ‘Julius Maggi’ who was founder of Nestle Group. And they had sold products
under the trademark since 1974 in India.
