Ralcorp Holdings’ bowl-shaped tortilla
chips did not infringe on trademarks for Frito-Lay North America’s similar
bowl-shaped chips, according to a verdict filed in the U.S. District Court,
Eastern District of Texas, Bizjournals.com reported.
Frito-Lay, owned by PepsiCo alleged the
BOWL! by Ralcorp Holdings’ for infringing on the patents and trademarks of its
SCOOPS! brand. They claimed that the Ralcorp Holdings started to sell after
their SCCOPS! chips.
“Frito-Lay has invested significantly in
this product and it has enjoyed widespread consumer acceptance and success,” “(Ralcorp’s)
infringement of Frito-Lay’s intellectual property rights harms Frito-Lay as well
as Frito-Lay customers who may be confused and deceived...” Frito-Lay said in
its complaint, the article reported.
