China Proposes New Export Restrictions on AI Technology
China | AI & Technology Export Controls | October 16, 2026
On October 16, 2026, China's Ministry of Commerce and Ministry of Science and Technology proposed revisions to the country's technology export control list, covering 40 technologies in areas in including artificial intelligence (AI), biotechnology, and solar energy. Of course, 23 are AI-related, including large-scale AI models, AI agents, and high-performance computing technologies.
The proposal focuses on controlling the overseas transfer of sensitive AI technologies that could affect national security or critical infrastructure. However, it does not seek to restrict all international access to Chinese AI services. Access through APIs, websites, apps, and cloud-based services would generally remain outside the proposed restrictions. Publicly available open-source technologies and technologies disclosed in academic publications would also be excluded.
The proposed changes also raise important considerations for intellectual property (IP) management and technology transfer. Even when companies own patents or trade secrets covering AI technologies, they may need to comply with additional export controls when transferring or licensing those technologies to overseas partners.
The proposal is currently open for public comment until November 25, 2026. The final rules and implementation timeline have yet to be confirmed. How these potential restrictions will shape international AI collaboration, technology licensing, and IP commercialization remains to be seen.
