[WIPS Global] Standard Essential Patent Search

 

 Standard essential technology is a technology that must be implemented in order to implement standard specifications, and it is impossible to manufacture, sell products or provide services without infringing the technology. When this technology is applied for and registered, it’s called a standard patent. In other words, Standard Essential Patents (SEPs) are technologies included in standards established by standard organizations, and also protect technology that is essential to implementing standards. Therefore, standard patents combine the ‘market dominance’ of standards and the ‘monopoly power’ of patents.

 Companies develop various technologies and apply for patents while participating in the standard process as technical contributions, but not all technologies applied in this way become standard essential patents. A standard essential patent is granted only when it is adopted as a standard specification in the standard process and registered in the examination.

 Technology that has been developed and applied for a patent for a technical standard, but has not been adopted as a technical standard or has not been registered as a patent, is called standard-related invention or standard-related patent. As the number of standard technologies increases, the need for standard patent searches for companies that produce products using standard technologies is increasing.   We can use search fields in 'Field Search' to search SEPs. Under the technologies we're looking for, we can use search fields of as presence/absence of SEPs, standard organization, SEPs number, declarant, declarant nationality and declaration date.

 When run a search, icon for SEPs appeared in the result list and filtering options on the left along with the list. We can check the existence of SEPs and standard organization for the listed patents.

 We also can see all the filtering options as chart. If click on a chart, it refines the entire charts reflecting the clicked item.

  Let's take a quick look at the standard organizations. There are more than 100 standard organizations around the world that establish standards. Basically under the United Nations, ITU, Europe's ETSI, forums/ consortiums involving companies and experts, such as IEEE, IEEE, and W3C.

 In WIPS Global, ETSI (European Telecommunication Standards Institute), ITU-R (International Telecommunication Union-Radio Communication Sector), ITU-T (International Telecommunication Union-Telecommunication Standardization Sector), IEC (International Electrotechnical Commission), IEEE (Institute of Electrical Electronics and Engineers) ISO (International Organization for Standardization), ATSC (Advanced Television Systems Committee), ISO/IEC JTC1 (ISO and IEC Joint Technical Committee), etc.

 In addition, data of MPEG-LA, SISVEL, and Access Advance, which are patent pools, are also provided. A patent pool is a standard organization established to unify patent management and licensing as multilateral negotiations began to be required due to the large number of patent holders of MPEG technology among many technologies.

 The newly added tap for SEPs shows the detail information of the patent in the View Details. The Declared Patents list patents declared by the actual stand organization or granted standard information through its own patent family. Click the document icon, the original copy of the declaration on standard information issued by the standard organization.

 The Related Patents section below declared Patents section lists a set of patents that have all standard information that the searched patent has. Based on the patent number in the screenshot above, it is a set of documents that have any of the following standard information.

 In the ‘SEPs Analytics’ tab on the left, the secondary analysis charts have added country distribution by standard organization, declarant distribution by organization, and country distribution by declaration year.


Additionally, I'd like to introduce 'Similar Patent'.

 It is a feature that we can use easily when we want to quickly find similar patents while reviewing detailed information of a patent. 10 similar patents are listed in order of similarity to the patent being reviewed. Core keywords, Abstracts, Claims and Drawings are displayed for each listed patent.
