‘Tiffany Setting’ is a generic term, Costco says.

Costco has been sued by Tiffany & Co. for selling Tiffany’s diamond rings. But it said the term of ‘Tiffany Setting’ is a generic, not a trademark of Tiffany & Co. jckonline reported.

Costco asked back to Tiffany that be prohibited and enjoined from ever again asserting false claims of right to exclude use of Tiffany as a generic term of a style or type of a ring setting,”. It also said that they have never sold ‘Tiffany rings’ and they sold unbranded rings which has ‘Tiffany settings’.

Tiffany & Co. responded that Costco infringed Tiffany’s trademark when they sold products which had nothing related to Tiffany & Co. and used the word ‘Tiffany’. They are ready for upcoming court case, Tiffany & Co. spokeswoman added.
