'Montessori' Trademark Rights Revoked

Agaworld claimed the Supreme Court of Korea to invalidate Han-kuk (Korea) Motessori’s trademark rights after being sued by Montessori for using the word ‘montessori’. The court made final decision that the word ‘montessori’ can’t be exclusive rights for a specific company.

Korea Montessori has application history from 1993 to 2009, but it doesn’t mean that it has distinctiveness acquired through use because other companies and kindergartens also filed trademark with montessoi word in many ways, the court added.

The word ‘montessori’ is originally derived from an Italian physician and educator Maria Montessori. Montessori education means an educational approach for children developed by Maria. There are a lot of education publishing companies using Montessori education and it is widely known as books and teaching materials
