Italian Data Protection Agency decides to
temporarily block access to 'ChatGPT'
On Mar. 31, 2023, the Italian Data Protection
Authority (Garante) decided to temporarily block access to 'ChatGPT', as a
first for Western countries.
‘ChatGPT’
is a conversational artificial intelligence released on Nov. 30, 2022 by
OpenAI, an artificial intelligence (AI) company. It is estimated to have
reached 100 million monthly active users within two months of launch, making it
the fastest-growing consumer application in history.
On Mar.
20, 2023, an incident occurred in which an email verifying personal information
was sent to an unrelated user when signing up for OpenAI. It is said that it
contained personal information such as other user’s name, email address, bill
address, last four digit number of credit card and expiration date.
Furthermore, OpenAI has been criticized for not disclosing details about how to
train AI models from several countries including the US.
The decision in detail is as follows.
The Italian Data Protection Authority imposed
immediate temporary restrictions on the processing of user data, claiming that
“there is no legal basis to justify the collection and processing of personal
data on a large scale to train ChatGPT’s algorithms”.
Despite the fact that OpenAI's terms of service
state that the service is intended for users over the age of 13, the lack of an
age verification mechanism may result in responses that may negatively affect
perceptions by children. In addition, since the information provided by ChatGPT
does not always match the actual situation, there is an aspect where personal
information is processed inaccurately.
OpenAI must take action against possible
breaches of data protection within 20 days. If not, they will face fines up to
€20 million or 4% of annual revenue.

Meanwhile, the European Commission (EC)
announced that it would not ban the use of ChatGPT at the EU level.

Canada's National Finance Commission announces
ban on use of 'Tik Tok'
on government mobile devices
On Feb. 27, 2023, the Treasury Board of Canada
issued a statement prohibiting the use of ‘TikTok’ on government mobile devices
for privacy and security reasons.
From Feb. 28, 2023, the use of TikTok on mobile
devices belonging to the Canadian government is prohibited, and new downloads
of TikTok and previously installed applications are included in the target of
removal.
According to Mona Fortier, chairman of the
National Finance Commission of Canada, the Canadian government regularly
monitors the system for information security and takes measures to prevent
risks.
The method by which TikTok collects data from
mobile devices is clearly risky because it’s requiring significant access on
the device. Canada's Chief Information Officer (CIO) has also determined that
TikTok presents an unacceptable level of risk to privacy and security.
The decision to remove and block TikTok from
government-affiliated mobile devices will be taken as a ‘precaution’ in line
with other international partners, considering concerns about the legal regime
that controls information collected from mobile devices.
For the general public, using social media and
platforms is a personal choice, but the Communications Security Establishment's
Cyber Security guidance states that Canadians should fully understand the risks
before deciding to use social media and platforms. and strongly recommends
making a choice based on appropriate information.
The Government of Canada's Policy on Service
and Digital outlines acceptable/unacceptable ways for government employees to
use electronic networks and devices. Institutions and state-owned enterprises
not covered by this policy are being notified of TikTok removal.

Canada's National Finance Commission chairman
Mona Portier said Canada's decision to ban TikTok was consistent with the
decisions of the US federal government's majority states and the European
Commission (EC). Regarding the Canadian announcement, TikTok said it was very
regrettable that it was announced without prior contact with TikTok after the
ban in the US and EU, and that the Canadian authorities blocked TikTok without
any attempt to cooperate to achieve a common goal.
