European Commission IP Helpdesk, analyze issues related to ‘Intellectual Property Rights of ChatGPT’


On Feb. 20, 2023, the European IP Helpdesk1) under the European Commission (EC) analyzed and reported issues related to ‘ChatGPT’s intellectual property rights’

ChatGPT is a chatbot launched by Open AI, an artificial intelligence (AI) company, and was originally created to support online customer service.

What is ChatGPT?

ChatGPT is an automatically generated chatbot that extracts data from textbooks, newspapers, websites, etc. After collecting a large amount of data, it summarizes the contents through natural language processing (NLP) and provides it as similar to human language as possible. ChatGPT basically provides answers to questions through artificial intelligence, and makes various contents that can be protected by law, such as song lyrics and text translation.

Who owns the content created by ChatGPT?

Content generated by ChatGPT may be copyrighted, but AI itself cannot own the content. According to European and US laws, AI cannot own copyrights because it does not have legal personality, which is a prerequisite for owning intangible assets.

Can we use content created by ChatGPT?

No legal issues as a personal conversation aid. However it may cause copyright issues because the it’s often derived from existing contents. Therefore there’s possibilities for ChatGPT users to infringe on the copyrights of others if the produced results has a high similarity to an existing work is produced

How can ChatGPT help in terms of intellectual property rights?

It is expected to have various advantages in the field of intellectual property by ① providing information on patents, trademarks, copyrights, and trade secrets, ② drafting of patent claims, and ③ support for research on intellectual property law or case law.
