South Korean Universities' IP Assessment

WIPS, Korean ETnews and Korean Patent Attorneys Association did collaboration research and the result has been published in the ETnews on 23rd, . 

The research targeted 113 South Korean universities holding more than 10 patents.  The research categorized the evaluation items by IP culture (policy of the university, support, systems, etc.), IP power (the number of applications/ number of granted patents), global competitiveness (overseas patent application/number of overseas granted patents), and industry contribution (technology). 

Every category’s highest score is 900 points each.  Based on year of 2012, we summarized the material through the university by using the survey information and analyzed the data that we collected. As a result, Hanyang University ranked in the first place and Korea University took the next place.

2013 Korea Trademark Design Week

It’s Korea Trademark Design week, there will be various events and exhibitions held from 2~6 Dec.

TM5 Annual Meeting is the main event. 5 countries (Korea, Japan, Europe, China and US) host this event and it will be the hosted in Seoul this year. US, Japan and Europe Patent Office started this meeting in 2001, Korea joined in 2012 and China in 2012.

Sony’s wearable device ‘SmartWig’ patent

Sony filed a patent application for ‘SmartWig’ which can be attached on hair. According to the BBC News, the SmartWig will be able to process data and communicate with other devices.

In the filing, the SmartWig includes laser pointer, camera, sensor and etc. With these devices and technology, it can measure user’s blood pressure and body temperature or can be used as navigation.

 "Wearable gadgets are definitely going to be one of the big areas of growth over the next two years," Andrew Milroy, an analyst with consulting firm Frost & Sullivan, told the BBC.

Burberry's tartan design revoked in China

Burberry’s tartan pattern copyright has been revoked in China, Time.com reported.

According to the article, China’s national trademark office reported that it revoked the copyright on Burberry’s tan, black and red tartan after a long battle with a Chinese company. 

The Trademark Office said that the copyright expired because Burberry had not used the pattern in China for over three years. Burberry spokesperson said the company will appeal the decision. Click to read the full statement from Burberry below.

Samsung's Iris Recognition Patent

Samsung Electronics revealed its new iris recognition-related patent.

According to KIPO, Samsung applied the patent for “iris recognition and proximity sensing apparatus” in May 2012.

GoldieBlox's commercial video copyright infringement suit by BEASTIE BOYS

This GoldieBlox’s video commercial has good message. It shows girls need their toys to encourage inventing and engineering, and it used popular song ‘Girls’ by Beastie Boys with different lyrics. Beastie Boys said they liked the commercial, but sued it for using their song without permission, USA Today reported. Beastie Boys posted an open letter saying they strongly support the message of the video, but they didn’t permit their song to be used in product ads.

The company launched their new toy product line for girls. GoldieBlox changed the lyrics of ‘Girls’ and make parody version. The video hits over 8 million views.

Copyright Battle over 'Hand of Harmony' sculpture in Pohang, Korea

A famous sculpture in Pohang city in Korea ‘Hand of Harmony’ is facing a copyright suit.

According to The Kyunghyang Shinmun, Dae-gu Police is investigating the sculpture which was built in 1999 by a design team of Yongnam University. The team is accused that they copied a hand-shape sculpture which also submitted an entry for a contest in 1999.

This 'Hand of Harmony' is famous in Pohang as a popular sight and tourist attraction.

'Prada Candy' vs. 'Party Candy'. Prada sues Preferred Fragrance Inc.

Preferred Fragrance Inc has been sued by Prada. This fragrance company introduced ‘Party Candy’ in 2011 and Prada accused that its product name violated Prada’s ‘Prada Candy’ copyright.

According to Huffington Post, the packages are also resembled. Both of packages has an illustration of a girl on pink color box and Prada sells its products for $82, and Preferred fragrance is only $3.99 online.

'Charbucks' is not a trademark infringement on Starbucks.

According to Oregon Live, a small coffee producer, Black Bear Micro Roastery, has won a trademark infringement case by Starbucks. 

This coffee producer sued in 2001 for using ‘Charbucks’. Charbucks is Black Bear’s darkest roast coffee which was introduced in 1997. Starbucks appealed to the 2nd US, but the court agreed with the district court.   

Starbucks respects but disagrees with the court's decision, company spokesman Zack Hutson said.

Google Books’ digital library is ‘fair use’, not copyright infringement.

Google has won a copyright lawsuit against US Authors Guild, Reuters reported.

The US Authors Guild sued Google alleging that its digital library violated copyright in 2005. It accused Google’s plan to scan more than 20 million books without permission. But U.S. Circuit Judge accepted Google's argument that its scanning of books constituted "fair use" under U.S. copyright law.

Denny Chin, the US Circuit Judge, wrote that the scanning makes it easier for students, teachers, researchers and the public to find books. He also wrote that "In my view, Google Books provide significant public benefits. Indeed, all society benefits."
